Van Gogh Alive Ticket Giveaway Terms of Entry

 

The Promoter is Andrew Kay Management. ABN 66 071 652 214 of 52 Stephenson Street, Cremorne 3121 (Promoter). https://www.akaaustralia.com.au/

 

  1. Eligibility

1.1 The promotion is available to all South Australian residents aged 18 years or over. Individuals must have a Facebook account in order to enter.

 

1.2 The promoter may, in its sole and absolute discretion, verify an entrant’s eligibility to enter the Promotion, and win a prize.

 

1.3 Representatives of the Promoter may contact entrants to determine their eligibility, however, if an entrant is spoken to by a representative of the Promoter, it does not mean they have been selected as a winners and they may not be awarded a Prize.

 

1.4 Session dates and times are subject to change by the Promoter. The Promoter takes no responsibility for changes to Shows which are outside of its control.

 

1.5 Entrants must be able to take the prize at any session 1 – 31 July, subject to availability.

 

1.6 Eligible entrants must provide either a valid email address or phone number

 

  1. Promotion Period

2.1 The promotion period commences at 3:00pm Wednesday 23 July and ends at 8:00pm Monday 28 July AEST (‘’Promotional Period’’).

 

  1. How to enter

3.1 Comment on the Facebook post

 

3.1.1 Read and consent to the Terms and Conditions of the promotion

 

3.1.2 Entrants will be able to submit their entry until “COMPETITION CLOSED” is announced.

 

3.1.3  Any cost associated with accessing the Facebook Page or Instagram Page is the entrant’s responsibility and is dependent on the Internet service provider used.

 

3.2 All Valid Submissions must be received during the Promotion period. Entrants may only enter the Promotion once.

 

  1. Monitoring and Moderation

4.1 The promoter reserves the right to monitor all entries.

 

4.2 The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an: entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

4.3  The Promoter reserves the right to remove any entries considered to be of an offensive or defamatory nature.

 

4.4  The Promoter reserves the right, in its sole and absolute discretion, to remove any entries that it considers to go against the spirit of the competition.

 

4.5  Incomplete or indecipherable entries will be deemed invalid.

  1. Determining the Winners

5.1 The prize winners will be determined by Tuesday 29 July.

 

5.2 The prize winners will be notified by Facebook Messenger

 

5.3 The prize winners will be individually judged based on, among other things, creativity and uniqueness

 

5.4 The prize winners must respond to the request for contact details from the Promoter within 1 business day of being contacted in order to claim their prize. Should the prize winner not respond within the time limit, the Promoter is within rights to contact the next eligible winner.

 

5.5 If for any reason the Promoter believes the Eligible Entrant has not complied with these Terms or the Promotion requirements, the Promoter may, in its sole and absolute discretion, refuse to award a Prize.

 

  1. Prize

6.1 There will be 6 prizes to be won, each consisting of:

  • One (1) double pass to Van Gogh Alive
  • One (1) drink per person

 

6.2 Each prize is valued at AUD($)130 including GST

 

6.3 The total prize value is AUD($)780 (including GST)

 

6.4 The prize cannot be exchanged, transferred, redeemed for cash or sold

 

6.5. The prize (tickets) will be delivered by either email or SMS delivery

 

6.6 No prize is transferable or exchangeable, nor can it be redeemed for cash. In the event for any reason a winner does not take an element of any prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied for that element of the prize.

 

6.7 If any prize is not claimed by the Prize Claim Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to award the relevant prize/s to the next best valid entry. If a prize is no longer capable of being redeemed, the prize will be deemed forfeited.

 

  1. General Conditions

7.1 Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including requiring an Entrant to provide identification and evidence of eligibility such as proof of identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms of Entry or who tampers with the Entry Method. Identification considered suitable for verification is at the Promoter’s discretion. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

7.2 If due to any reason whatsoever Promoter becomes aware after an Entrant has won a prize that the Entrant has not complied with these Terms of Entry, that Entrant will have no entitlement to the prize, even if Promoter has announced them as a winner and that Entrant will be required, at the direction of Promoter, to return, refund or otherwise make restitution of the prize.

 

7.3 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

 

7.4 Nothing in these Terms of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, Promoter (including the Promoter’s officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage including loss of opportunity; whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by Promoter) due to any reason beyond Promoter’s reasonable control; (d) any variation in prize value to that state in these Terms of Entry; (e) any tax liability incurred by a winner or Entrant; (f) participation in the Promotion; (g) if any prize event is cancelled or delayed for any reason beyond the reasonable control of Promoter; and/or (g) redemption of the prize including attendance at a prize event.

 

7.5 By entering this Promotion, you agree to the Promoter collecting, storing and using your personal information for its marketing purposes, including contacting by electronic messaging (email and SMS) for the purposes of marking and administration, including contacting the Entrant about future promotions, special offers, goods and/or services. The Promoter may use any personal information Entrants provide in connection with this Promotion for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. The Promoter may disclose the personal information Entrants provide for those purposes to its related bodies corporate, contractors and agencies connected with this Promotion and to relevant authorities in the relevant states.

7.6 This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
